Terms of Service

1. Agreement

These Terms of Service form an agreement between Optigestix and the organisation or individual using the platform (“you”). If you use Optigestix on behalf of a firm, you confirm you are authorised to accept these terms for that firm.

2. Accounts and access

• You are responsible for the accuracy of account details and for all activity under your workspace.
• Credentials must not be shared outside your organisation; use team member seats and roles instead.
• You must notify us promptly of any suspected unauthorised access.

3. Subscriptions and billing

• Plans are offered on Starter, Growth and Enterprise tiers, billed monthly or annually in advance.
• Annual billing is discounted; published prices are exclusive of applicable taxes such as GST.
• You may upgrade, downgrade or cancel at any time; changes take effect from the next billing cycle.
• Fees already paid for a current period are non-refundable unless required by law.

4. Acceptable use

You agree not to:

• Use the platform for unlawful purposes or to store unlawful content.
• Attempt to breach, probe or disrupt the security or availability of the service.
• Reverse engineer, resell or provide access to the platform to unauthorised third parties.
• Upload malicious code or material that infringes the rights of others.

5. Your data

You retain ownership of all project, financial and client data you enter into Optigestix. We process that data solely to provide the service, as described in our Privacy Policy. You may export your data at any time while your subscription is active.

6. Availability and support

We work to keep Optigestix available and performant, and provide support by email and chat according to your plan. Planned maintenance may occasionally interrupt access. Guaranteed uptime commitments apply only where an Enterprise agreement expressly provides an SLA.

7. Intellectual property

The Optigestix platform, brand, interface and documentation remain our property. Your subscription grants a non-exclusive, non-transferable right to use the platform for your firm’s internal business purposes.

8. Suspension and termination

We may suspend or terminate access for non-payment or material breach of these terms, with notice where reasonably possible. You may terminate at any time from your account settings or by contacting support.

9. Limitation of liability

To the extent permitted by law, Optigestix is not liable for indirect, incidental or consequential losses, including lost profits or lost data. Our total aggregate liability is limited to the fees you paid in the twelve months preceding the claim.

10. Changes to these terms

We may update these terms as the platform develops. Material changes will be notified in advance, and continued use after the effective date constitutes acceptance.

11. Governing law and contact
